Lo que sí
podemos decir
en anuncios.
Every subsidy claim in Pon el Sol's ads, fact-checked against official Spanish government sources. Exact numbers, exact wording, exact expiration dates. Last checked April 22, 2026. Re-check monthly.
Legal basis
Ley 3/1991 publicidad engañosa
00Why this page exists.
Every number in a Facebook ad, Meta ad, blog post or LP for Pon el Sol must be defensible against a regulator.
Misleading subsidy claims in ads can result in fines of EUR 5,000-100,000+ per violation from Consumer Affairs or the Spanish advertising self-regulator (Autocontrol). We do not gamble with this.
The rule
Every percentage, every euro number, every deadline in any Pon el Sol ad or post must appear in this document with an official source and a "last-checked" date less than 30 days old. If it's not here, it doesn't go into an ad.

01Claim 1 — IRPF Deduction.
Our original claim: "20-60% IRPF deduction." Verdict: partially correct but misleading for individual homeowners.
⚠ Partially correct
IRPF deduction is 20% OR 40%, not a "20-60%" range
Federal tax law · Real Decreto-ley 2/2026 · AEAT source
What official sources say
Three tiers exist, each with separate requirements:
• 20% — requires min. 7% reduction in heating/cooling demand. Base cap €5,000/year (max deduction €1,000).
• 40% — requires min. 30% reduction in non-renewable primary energy consumption OR upgrade to energy class A/B. Base cap €7,500/year (max deduction €3,000).
• 60% — applies to building-wide rehabilitation (community buildings / apartment blocks), NOT individual single-family homes. Cumulative cap €15,000 over 4 years (max deduction €9,000).
Expiration dates
• 20% and 40% deductions: extended to 31 December 2026 via Real Decreto-ley 2/2026
• 60% deduction (buildings): extended to 31 December 2027
Caveats — do not say
• Never use "20-60%" as a range for individual homeowners — the 60% only applies to apartment buildings.
• Always require the energy-efficiency certificate pre/post condition in fine print.
• Solar panels alone typically qualify for 40%, not 20% (which is for heating/cooling demand reduction).

02Claim 2 — IBI Sevilla 30 years.
Our original claim: "Sevilla 50% × 3 yr + 30% × 27 yr = 30 years total." Verdict: partially correct but not guaranteed for 30 years.
⚠ Partially correct
Sevilla IBI is 50% × 3 years, then 30% in following periods — but not a 30-year guarantee
Municipal tax · Ordenanza Fiscal Ayuntamiento de Sevilla · direct source
Official wording (Ordenanza Fiscal)
"Bonificación del 50%, para inmuebles de uso residencial en los que se instalen sistemas de aprovechamiento de la energía solar, en los tres períodos impositivos siguientes a su instalación, que pasará a ser del 30% en los siguientes períodos."
What this means
- 50% bonification during the 3 tax periods following installation
- 30% in subsequent tax periods — continuation depends on maintained certification
- No fixed end date in the ordenanza, but also no 30-year guarantee
- The "30 years" figure is a marketing extrapolation (used by Prime Energy and others), not a municipal commitment
- Applies to residential properties only; requires installation certificate per Royal Decree 1027/2007
- Application must be submitted before March 1 of the tax year
Caveats — do not say
• Do not claim "30 years guaranteed" — the ordenanza can change annually.
• Do not promise your children will inherit the benefit — not a transferable right.
• Application deadline March 1 is critical and often missed — mention it if promising the benefit.

03Claim 3 — Next Gen EU 40% / €600/kWp.
Our original claim: "Next Gen EU = 40% direct discount, up to €600/kWp." Verdict: INCORRECT (outdated).
✗ Incorrect (outdated)
The €600/kWp regime expired end of 2024 — it's now INEA at variable rates
Regional funding · Junta de Andalucía · INEA programme
What actually exists in April 2026
The original Next Gen EU programme (Real Decreto 477/2021, €600/kWp residential) ended in 2024 and was NOT extended under identical terms.
Current framework in Andalucía (2026):
• INEA programme — Programa de Incentivos para Energías Renovables
• Funded by FEDER 2021-2027 + Next Generation EU
• Managed by Agencia Andaluza de la Energía
• Subsidy range: 25-70% depending on beneficiary type
• Actual 2025 ranges: €300-1,100/kWp for panels, €140-490/kWh for batteries
• Subject to budget availability and active convocatoria
IDAE Second Call (Proyectos Innovadores): Jan 14 — Feb 19, 2026 — innovative projects only, not standard residential.
Sujeta a disponibilidad presupuestaria y convocatoria vigente."
Caveats — do not say
• Do NOT say "40% direct discount" — that tier is gone.
• Do NOT say "€600 per kWp" as a fixed figure — the RD 477/2021 programme expired.
• ALWAYS verify the active INEA convocatoria before a campaign launch — provincial budgets run out fast.
• The programme is competitive (concurrencia competitiva), not guaranteed.

04Claim 4 — ICIO 95% in Andalucía.
Our original claim: "ICIO exemption up to 95% in Andalucían municipalities." Verdict: correct as a cap, but not universal.
⚠ Partially correct
95% is the legal maximum — not the standard in every municipality
Municipal tax · Ley Reguladora de las Haciendas Locales art. 103.2.a
What's confirmed
• ICIO bonifications are potestative (voluntary per municipality); legal maximum cap is 95% (art. 103.2.a LRHL)
• Confirmed 95% in: Sevilla, Málaga, Granada, Córdoba
• Smaller Andalucían municipalities vary: 50-75% or no ICIO bonification at all
• Must be applied for BEFORE works begin, otherwise forfeited
• 65% of Spanish municipalities offer ICIO rebates for autoconsumo solar (national average)
Caveats — do not say
• Do NOT say "95% ICIO in all of Andalucía" — only major cities confirmed.
• ALWAYS mention application must be pre-works (otherwise cannot claim retroactively).
• For smaller municipalities, say "check your ayuntamiento" — don't promise a specific %.

05Claim 5 — Stacking to 70%.
Our original claim: "Stack all four subsidies = homeowner recovers up to 70%." Verdict: UNVERIFIED / MISLEADING.
🟡 Unverified / misleading
70% is an upper bound — realistic recovery for average customer is 40-60%
Legal risk · Ley 3/1991 publicidad engañosa
Maths check on a 5 kWp install (~€7,500 gross)
Best-case stack (optimal conditions):
• INEA subsidy: 30% of €7,500 = €2,250
• IRPF deduction (40% over max €7,500 base): €3,000 fiscal saving
• ICIO 95%: typical ICIO is 3-4% of project, 95% of that = ~€150 saved
• IBI (first 3 years): €50-60/year × 3 = €180 total
Total best case: ~€5,580 on €7,500 = 74%
Realistic average case:
• INEA 25% = €1,875
• IRPF deduction applicable (depends on tax base): €1,500-3,000
• ICIO 95% city: €150
• IBI: €150
Realistic range: €3,675-5,180 on €7,500 = 48-69%
Legal benchmark for "hasta 70%": valid ONLY IF we attach clear disclaimers about individual circumstances.
Caveats — do not say
• Do NOT say "tot 70%" as an unqualified promise — legal risk under Ley 3/1991.
• ALWAYS use a range (40-60%) + disclaimer about individual situation.
• If using the number "70%" anywhere: preface with "en el mejor de los casos" or "en función de tu situación".
• Never promise specific euro recovery — always describe as a range.
